Before a Consumer Complaint in India: Does a Legal Notice Help?

When a product fails or a service falls short, many people first send the seller or service provider a formal notice, and only then go to a Consumer Commission. A notice is not a legal precondition for most consumer complaints, but it often shapes what happens next.

General information, not legal advice.

Is a notice compulsory?

The Consumer Protection Act, 2019 does not, as a general rule, require a consumer to send a legal notice before filing a complaint. A complaint can be filed directly before the District, State or National Commission with jurisdiction.

That said, a notice is common practice, for good reasons.

What a notice can achieve

What to include

  1. Your details and the opposite party's details, including any order number, invoice number or policy number.
  2. The transaction. What was bought or booked, when, and for how much.
  3. The defect or deficiency. Describe it factually: dates, what you observed, and what you reported.
  4. Previous complaints. Ticket numbers, emails and the responses you received.
  5. The remedy sought. Replacement, repair, refund, compensation, or a combination.
  6. A reasonable deadline, such as 15 days, after which you intend to approach the Consumer Commission.

Avoid exaggeration and threats. A calm, documented notice reads better before a Commission than an angry one.

Keep the time limit in mind

Under Section 69 of the 2019 Act, a complaint should be filed within two years from the date on which the cause of action arose. The Commission can admit a late complaint if sufficient cause for the delay is shown, but it is safer not to rely on that. Waiting for a reply to a notice does not automatically extend the time.

Sending and proof

Send the notice in a way that lets you prove delivery, such as registered post with acknowledgement, speed post with tracking, or email to an official address. Keep copies of everything.

After the notice

If the matter is not resolved, the complaint can be filed, including online through the e-Daakhil portal for consumer commissions. Attach the notice, proof of delivery and any reply.
